Lahore: This was stated by Inspector General of Police Punjab, Mohammad Habib-ur-Rehman while addressing to the relatives of martyrs, Police Jawans and media representatives at the office of DPO Gujarat, Rana Shahid Pervaiz. RPO Gujranwala, Mohammad Amin Wains and police officers of district Gujrat were also present on this occasion.

IGP further said that the police uniform is a national trust and Justice cannot be acquired once it is breached. He said that a day of Justice is better than 60 years of worship. He asserted that “Thana Culture” can only be changed by doing good with a dutiful conscience.

Later, IGP distributed an amount of Rs.1, crore 20 lac among the heirs of the Shaeed Constables. Each Constable namely, Sibgat Azam Shaeed, Qamar Ali, Seerat Abbass and Head Constable Mohammad Arshad’s relatives received individual checks of Rs. 30 lac. Moreover, IGP also directed for immediate appointment of two sons/brothers of Shaeed Constables in Police Department as per policy.

Meanwhile, Inspector General of Police Punjab, Mohammad Habib-ur-Rehman has announced commendation certificates for RPO Bahawalpur, Abid Qadri and his team to foil the nefarious designs of terrorists to blast IMAM BARGAH district Muzaffargarh and Police Line Rahim Yar Khan, by adopting a successful strategy yesterday.

It is pertinent to mention here that Bahawalpur Police has recovered 6 bags of explosive material, each weighing around 50 to 60 Kg, along with 10 pins of Detonators and a circuit board for Remote Control.

Supreme Court hears Suo Motu case no. 7 of 2009

Islamabad: A two member bench headed by the Hon’ble Mr. Justice Iftikhar Muhammad Chaudhary, Chief Justice of Pakistan and Hon’ble Mr. Justice Tariq Parvez heard Suo Motu Case No. 7 of 2009 (Harassment by the Gujranwala Police to Journalist and General Public).

Mr. Razzaq A. Mirza, Addl. AG, Mr. Athar Ismail, SP Saddar, Mirza Qamar-uz-Zaman, DSP Legal and Rana Mohammad Anwar, SCP Legal, Gujranwala appeared on Court’s notice. The bench heard the case and passed following order:-

“It is informed by the learned Additional Advocate General that FIRs No.142 and 146 of 2009, registered against Hafiz Shahid Munir by the Gujranwala Police, have culminated into his acquittal recorded by the Courts below on 03.09.2009 and 22.10.2010, allegedly for want of prosecution evidence.

We have enquired from learned Additional Advocate General that if there was no substance or evidence, then why the accused was challaned, because due to such conduct on the part of the Police he had suffered the agony of the two trials for a considerable period to which he could not answer satisfactorily.

2. It may be noted that this incident show how the police/law enforcing agencies behave with the citizens, knowing well that except creating harassment to the accused, at the end of the day, nothing will come out from such baseless case. Contrary to it, where there are genuine cases of commission of the crime, those are left negligently without taking any action.

Such attitude of the police has created a situation that the Courts are left with no option but to acquit the accused for which the Courts are being blamed, whereas the prosecution/police, knowing well about fate of the case, sends challan in Courts just to show that they have performed their duty but the Courts are acquitting the accused.

3. We feel that whenever such situation arises, it becomes the duty of the Supervisory Officer of police to look into the matter and find out the defect and the reasons as to why an accused has been acquitted and if the person i.e. SHO or IO is responsible for failure of the case, the Supervisory Officer should take action against them and if they are of the opinion that the cases put up by the police in Court has substance but acquittal resulted, would call for interference by the superior Courts to which they should approach the Courts by filing appeals against such orders.

4. Under these circumstances, we direct the Inspector General of Police Punjab to take both these cases as test cases for the purpose of setting deterrence by determining the real facts and circumstances and should fix the responsibility upon the police officers/officials responsible for the same. He is further directed to file a detailed report showing that for the last one year, how many accused were challaned and what is the rate of acquittal or conviction and as to how many appeals against acquittal were filed and whether conviction judgments of the original Courts have attained finality by the superior Courts or not. He is required to submit report in this regard before the next date of hearing.

Adjourned to 22.03.2012. Hafiz Shahid Munir is not required to attend this Court, unless otherwise directed.”

Supreme Court Official Placed Under Suspension

Islamabad: The Registrar Supreme Court has placed under suspension Mr. Muhammad Yousaf Jan, Judicial Assistant, working in the Record Section of the Court and has further initiated disciplinary proceedings against him under the Supreme Court (Appointment of Officers and Servants and Terms and Conditions of Service) Rules, 1982.

The allegation against the officer was that he contributed to the publication of false/misleading news story to the effect “Documents on immunity stolen from house of Supreme Court official” with a view to sensationalize a non-issue. The suspension order states that he acted in a most irresponsible/unprofessional manner, which is contrary to office discipline and rules of code of conduct.

Prior to this, his explanation was called and his reply was found unsatisfactory and full of contradictions. Therefore, he has been placed under suspension.

It is pertinent to mention here that Mr. Yousaf Jan Marwat is a Judicial Assistant working in Record Section of Supreme Court, Islamabad. He had reported to police regarding burglary incident at his residence on 15.03.2012 which created media hype and some misleading stories were also attributed to the Supreme Court. As per Police report, he informed the police that the locks of his house were broken but nothing was found missing.

In his explanation however, he stated that two perfumes and some study and research material were missing, but he asked the police not to make it part of the complaint. Further, he also stated that he stressed on the police to proceed with the matter confidentially and secretly. This perhaps aroused unnecessary suspicion and speculative reports in the media. He further admitted that some media persons knew that he is doing research on issue of immunity.

Working in the Record Section, he is not required to carry out any research nor was any such assignment given to him.

It may be stated that Supreme Court has already contradicted the news story which appeared in section of media by issuing two Press Releases on 16th and 17th March, 2012 (copies enclosed).
