Srinagar, June 13, 2023 (PPI-OT): Legal experts, mostly members of Kashmir Bar Association, has termed the Indian government’s latest move of removing words the “Government of Jammu and Kashmir” from Article 112 of the Limitation Act of its constitution as blatant violation of the UN mandate on Kashmir. The experts were responding to the recommendations made by the Law Commission of India that the words “‘including the Government of Jammu and Kashmir’ should be deleted from the Article 112 of the Limitation Act due to applicability of the law to Jammu and Kashmir”.
The legal experts in their media interviews in Srinagar said, India cannot make a mention of Jammu and Kashmir as a part of India, and application of its laws to the UN-designated disputed territory is violation of the UN Security Council on Jammu and Kashmir. It is worth mentioning here that India’s Law Commission has recommended that “Section I of the Limitation Act provides for the short title, extent and commencement. Sub section (2) of Section I of the Limitation Act was as follows: It extends to the whole of India except, the State of Jammu and Kashmir”.
“The words except the State of Jammu and Kashmir” were omitted by the Jammu and Kashmir Reorganisation Act, 2019 (34 of2019). “Therefore, it is expedient to delete the words ‘including the Government of the State of Jammu and Kashmir’ from Article 112,” reads the panel’s recommendation. The legal experts urged the United Nations to refrain India from fiddling with its political future in contravention to the aspirations of the Kashmiri people.
