Supreme Court Hears CMA NO. 496 OF 2012 in Civil Petition NO. 24 OF 2012

Islamabad: A three member bench headed by the Hon’ble Mr. Justice Iftikhar Muhammad Chaudhary, Chief Justice of Pakistan and comprising other two members namely Hon’ble Mr. Justice Khilji Arif Hussain and Hon’ble Mr. Justice Tariq Parvez heard CMA No. 496 of 2012 in Civil Petition No. 24 of 2012 (For Extension of Time).

Earlier, the Civil Petition No. 24 of 2012 (On appeal from the judgment/order dated 15.12.2011 passed by High Court of Sindh, Karachi in Constitution Petition No. D-3821/2011) was heard on 01.02.2012 and the operation of the impugned order dated 15.12.2011 passed by the learned High Court of Sindh in Constitution Petition No. D-3821/2011 was suspended and respondent No. 1 was directed to deposit the outstanding amount with the Nazir of High Court of Sindh, Karachi within three days positively.

Today, the case was heard and Mr. Afnan Karim Kundi, ASC appeared on behalf of petitioner, Malik Qamar Afzal, ASC appeared on behalf of respondent No. 1, Amjad Ali, Electric Inspector appeared on behalf of respondent No. 4 while Irfan Gul, Legal Advisor, NEPRA appeared on behalf of respondent No. 2 and 3 and the bench passed following order:-

“Despite our directions, contained in earlier order, respondent No. 1 has failed to comply with the same. Issue notice to him to explain as to why he should not be proceeded against for non-compliance of the order of this Court, referred to hereinabove. Adjourned for 16.02.2012.

2. Office is directed to serve notice upon the respondent BY FAX, during course of the day, through In charge, Branch Registry, Karachi, who is also directed to submit compliance report BY FAX.”
