IIOJK High Court Urges Prompt Release of Detainees After Quashing Detention Orders

Srinagar, The High Court in Indian Illegally Occupied Jammu and Kashmir (IIOJK) has emphasized the need for authorities to promptly release individuals whose detention orders have been nullified by the judiciary, highlighting the importance of adhering to legal standards and protecting individual rights.

According to Kashmir Media Service, Justice Rahul Bharti made these remarks while addressing a contempt petition related to the delayed release of detainees even after the court had ordered their immediate freedom. The case involved the unjustified continuation of custody for an individual, identified only as Shenwari, who remained detained for 79 days post the quashing of his detention order.

Justice Bharti expressed the court’s concern over the unnecessary and illegal prolongation of detention, stressing that such incidents should not recur. The High Court’s observation serves as a directive to authorities to act swiftly in complying with judicial orders, ensuring that detainees are released without undue delay once their detention lacks legal backing.
