Mumbai, A significant legal move has been made in Mumbai with a petition filed in the High Court, seeking the registration of FIRs against three Members of the Legislative Assembly (MLAs) for allegedly making hate speeches. The MLAs in question are Maharashtra BJP MLA Nitesh Rane, Telangana BJP MLA T Raja Singh, and independent MLA from Mira Bhayander, Geeta Jain, who supports the BJP. This action follows incidents of violence in the Mira Road area north of Mumbai in January.
According to Kashmir Media Service, the petition has been brought forward by five individuals, including two victims of the violence, who felt compelled to seek legal intervention due to the absence of FIRs against the speeches they allege incited further violence. The High Court is expected to hear the plea on March 27.
The petitioners, Aftab Siddique, Ashfak Ali Akbarali Shaikh, Asgar Ali Shakoor Raeen, Ismail Khan, and Sajjad Khatib, all residents of Thane and Mumbai, assert that violence broke out in a minority locality on January 21. They allege that during this period, Rane, Jain, and Singh made visits to Mira Road, making threats against the minority community through their speeches and media interviews.
They are requesting that police stations in Naya Nagar (Mira-Bhayandar police commissionerate) and Shivaji Nagar and Ghatkopar (Mumbai police commissionerate) be directed to file FIRs against the three MLAs for their purported hate speeches made between January and February.
The petition highlights several instances of assaults on members of minority communities following the alleged hate speeches and criticizes the police for not registering FIRs related to these speeches or subsequent attacks. It points out the lack of police action in instances where complaints were filed, and no arrests have been made in cases where FIRs were registered for attacks or vandalism against minority group members.
The petitioners accuse the police of failing to adhere to the Supreme Court’s mandate by not registering FIRs against the hate speeches, despite widespread media coverage and public knowledge of the incidents.
This plea represents a crucial legal challenge against hate speech and the handling of communal violence, underlining the petitioners’ demand for accountability and justice from the legal system.
