UN Experts Criticize Overturning of Harvey Weinstein’s Rape Conviction

Geneva, UN experts have voiced their concerns over the recent court decision to overturn the 2020 rape conviction of Hollywood producer Harvey Weinstein, highlighting its potential negative impact on the confidence of women survivors of sexual violence in the justice system.

According to Office of the High Commissioner for Human Rights, the experts are dismayed by the court’s ruling, which they believe could undermine the trust of victims in obtaining justice. They expressed distress over how the overturning of the conviction could fail those who have bravely come forward with their experiences of sexual harassment and abuse.

Weinstein, who was originally sentenced to 23 years in prison in New York after allegations from over 100 women, has seen his sentence overturned by the New York Court of Appeals in a narrow 4-3 decision. The court cited an unfair trial, arguing that certain testimonies from women not named in the charges should not have been allowed. A new trial has been ordered, while Weinstein’s separate 16-year sentence for rape in California still stands, with an ongoing appeal.

The UN experts also pointed out the potential retraumatization of the survivors if a new trial proceeds, emphasizing the distress and additional harm it could cause. They stressed the importance of maintaining a justice system that does not perpetuate impunity, especially for men in power accused of sexual violence and abuse.
