IIOJK High Court Quashes Two Detention Orders, Upholds One


Srinagar, The High Court in Indian illegally occupied Jammu and Kashmir (IIOJK) has quashed two detention orders under the Public Safety Act (PSA), leading to the release of the detainees, while it upheld another order, affirming the lawful application of the Act by the authority.



According to Kashmir Media Service, Justice Vinod Chatterji Koul of the IIOJK High Court declared the detentions of Saboor Ahmad Shergojri from Zainapora Shopian and Mushtaq Ahmad Ganaie from Sangri Colony Baramulla invalid. The authorities had detained Shergojri and Ganaie on September 27, 2023, and April 29, 2023, respectively, under charges that the court later found to be improperly substantiated.



The court pointed out that in Shergojri’s case, there was no evidence that the detention authority had properly considered his legal representation. In Ganaie’s case, the court criticized the detaining authority for a lack of thoughtful consideration in the detention process, which it deemed inadequate to sustain the detention order.



However, the detention of Zahoor Ahmad Dar from Bandipora, who has been held since April 7, 2022, at Central Jail Kot Bhalwal Jammu, was upheld by Justice Rajesh Sekhri, who found that the detaining authority had correctly followed the requisite legal provisions.
